In a letter dated Thursday, 2 July 2026, Kakamega County Director of Education Stephen Arbere confirmed that an investigation launched following a complaint by Kakamega School found that Moses Mwawara Mwaruwa (Admission No. 10753) and Collins Luvisia (Admission No. 10250) were ineligible to participate in the competition.
The investigation was conducted under Article 14(f) of the KSSSA Constitution and Section 66(3)(a) and (c) of the Basic Education Act, 2013. According to the County Director, Butere Boys were accorded an opportunity to defend themselves before a determination was made.
"We regret to inform you that two of your students, namely Moses Mwawara Mwaruwa Adm. 10753 and Collins Luvisia Adm. 10250, were confirmed to be ineligible," reads part of the letter addressed to the school's principal.
As a result, the County Director ruled that Butere Boys violated Article 14(e) of the KSSSA Constitution and would therefore not represent Kakamega County at the 2026 Western Region Championships. The matter has also been escalated to the Directorate of Criminal Investigations (DCI) for further action.

The ruling brings to an end a case that began after Kakamega School lodged an appeal challenging the eligibility of several Butere Boys players following the Kakamega County football finals.
In its appeal, Kakamega School raised concerns over six players, citing alleged breaches relating to age eligibility, player registration, transfers and class repetition.
However, following investigations, the County Director's decision specifically confirmed Mwaruwa and Luvisia as ineligible.
The decision has significantly altered Kakamega County's representation at the Western Region Championships. County runners-up Musingu High School have now been declared the Kakamega County champions and will take up the county's first slot at the regional championships.
Kakamega School, who finished third after defeating Tande Secondary School in the third-place playoff, will now inherit the county's second qualification slot following the disqualification of Butere Boys.
The Western Region Secondary School Games are scheduled to be held in Bungoma from Saturday, 8 to Tuesday, 11 July.
Following the changes, Musingu High School have been placed in Pool A alongside Mbale High School of Vihiga County, Kibabii High School of Bungoma County and Nambale High School of Busia County.
Kakamega School will compete in Pool B, where they have been drawn against Bukembe Secondary School from Bungoma County, Emusire High School from Vihiga County and St. Anthony's Kolanya from Busia County.
