KRU elections given green light to proceed on Wednesday

The heavily contested Kenya Rugby Union (KRU) elections that have been the talk of town recently will finally take place on Wednesday.

This is after a truce between KRU and Sports Registrar Rose Wasike ended up with a consent at the High Court of Kenya which saw the latter withdraw her initial petition that suspended the Annual General Meeting (AGM) and effectively the elections that would be held in the meeting.

In a ruling issued on 28 March 2023, KRu were given the all clear to hold the AGM following the court order signed by State Counsel Martin Munene.

“By Consent the Appellant's Application dated 22nd March, 2023 be and is hereby settled on the following terms.

1. The Court orders issued on 22 March, 2023 staying/suspending the 1 Respondent's AGM notice dated 20 February, 2023 be and is hereby set aside, vacated or discharged and in its place, judgment be entered that the Annual General Meeting of the Kenya Rugby Union to proceed and to be held on Wednesday 29th March 2023 at 3PM in accordance with the Sports Act 2013 and the Kenya Rugby Union Constitution.

2. The 2nd Respondent shall use the Independent Electoral and Boundaries Commission (IEBC) or the Centre for Multiparty Democracy to conduct the By Election and Election during its annual General Meeting

3. The other prayers of the appellant be determined by the court as per the appeal.

4. The 1st Respondent's application dated 24 March, 2023 be and is hereby withdrawn with no orders as to cost,” the ruling read.

Wasike had filed an application at the High Court saying she did not agree with the Sport Dispute Tribunal's ruling that nullified the KRU elections held September last year and ordered for fresh elections.

Lady Justice Christine Meoli temporarily ordered the stay of the notice dated February 20, 2023 calling for the AGM scheduled for March 24, 2023, which ensured the elections were not held that Friday and no AGM took place.

The Sports Dispute Tribunal in its ruling on February 14 this year, said the elections were marred by irregularities including the AGM notice which fell short.

The Tribunal also lashed at Wasike accusing her of interfering with the elections.
