SDT set to address Francis Baraza's Ksh 4.5 Million lawsuit against Kenya Police FC

Police FC only paid Baraza Ksh 400,000 after he took them to court demanding close to Ksh 5 Million for unfair dismissal

Former Kenya Police FC head coach Francis Baraza has formerly sued the lawkeeprs for breach of contract and the case is set to begin at the Sports Disputes Tribunal (SDT) on December 13.

Baraza filed the case on November 22 according to documents in our possession and Kenya Police FC were given 14 days to file a response.

This is after Kenya Police failed to heed to a demand by Baraza’s lawyer that they pay him close to Ksh 5 million for unfair dismissal.

The demand was filed through Ochutsi Munyendo and Company advocates who gave Kenya Police one week to pay. According to the coach’s lawyer, he was paid just Ksh 400,000 being one month’s salary and hence their decision to sue.

In the suit, Baraza claims to have first been employed by Kenya Police in December 22 through a verbal contract with a net salary of Ksh 200,000 per month.

He says the engagement was meant to resuscitate the team’s then dwindling and erratic performance in the first leg of the Football Kenya Federation Premier (FKF-PL) 2022-2023 season.

“The claimant intelligently, scrupulously and miraculously executed his services restoring the respondent’s fallen pride, guiding them to a record third place at the completion of the FKFPL 2022-2023 season,” says part of the suit.

He adds that after his initial oral contract lapsed on June 2023, Kenya Police formally engaged him on June 28th 2023 for one year where he was to be paid Ksh 400,000 per month.

Baraza says he made recommendations to the team management during pre-season to reinforce the striking, midfield and defending departments while also recommending for the retention of striker Elvis Rupia.

He further blames the team’s goal drought to a decision by Kenya Police to sell off Rupia despite his advice to retain him.

In pursuit of his coaching career Baraza says he attended a CAF 'A' License Diploma Training in August 2023, as permitted by Kenya Police FC. Unfortunately, during the training, he suffered an Achilles tendon injury, which led to his temporary inability to engage in physical and aggressive activities related to coaching. He followed the medical advice provided and stayed away from such activities to aid his recovery leaving his assistant Salim Babu incharge.

He argues that despite not being available for training, he was summoned by the Kenya Police to a board meeting on September 18, 2023 where he was given an ultimatum to beat AFC Leopards in the next match or be fired.

Prior to that Kenya Police had drawn 0-0 against Kariobangi Sharks, lost 3-0 to Posta Rangers and drawn 2-2 against Shabana.

After the draw against Leopards, Baraza says he was called by Kenya Police team manager and asked not to attend training until further notice.

On September 28, he says Kenya Police unveiled Croatian Zradvko Logarusic as the new head coach without following due process as prescribed in the contract he had with the law keepers.

This is what Barasa is demanding from Kenya Police

1. Notice Pay - Kshs. 400,000/-

2. Constructive Dismissal - Kshs 3,200,000/-

3. Unfair Termination - Kshs 800,000/-

4. Advocates Collection fees at Kshs 100,000/-

The total amount demanded by Baraza's legal team is Ksh 4,500,000.
