Asad Khan murder: Court pushes back ruling on Maxine Wahome's case

A court in Nairobi has granted the Director of Public Prosecutions (DPP) and the Directorate of Criminal Investigations (DCI) 15 days to file a report on how the case against rally driver Maxine Wahome should proceed.

A ruling on whether or not the file against the kindergarten teacher will be closed in the murder of her boyfriend Assad Khan is set to be delivered on March 7, 2023.

The investigating officer had told the court that they were through with investigations and wanted to close the file since they had forwarded it to the DPP for advice but senior principal magistrate Benard Ochoi declined to withdraw the miscellaneous application, terming the request unfair and an abuse of court process.

"This court must be informed by the findings of the investigations it will be unfair for the misclellaneous application to be closed without the respondent being informed about the results that were being conducted against her. It would be an abuse of court process if the file is closed without the findings no matter what kind of investigations were being conducted.

“I give the DPP and the investigating officer 15 days to file a report of the findings and how they wish to proceed with the case,” Ochoi ruled

Further, the court directed that the property where Maxine and Khan lived, which had been marked as a crime scene, be released to the owner in the next five days.

"I direct that in the event they have not collected any evidence including forensic evidence and photographs I give him five days to do so and return the premises to the owner," Ochoi went on.

The late Khan was reportedly injured by Maxine on Jamhuri Day after she allegedly returned home drunk from a dinner party she had attended on the night of December 11.

Police arrested Maxine for grievous harm, but she was later released on a Ksh 100,000 cash bail.
